Rental Agreement

This Bin Rental Agreement (“Agreement”) is entered into between Yellow Bins Inc. (“Yellow Bins,” “we,” “us,” or “our”), an Alberta corporation, and the customer identified on the booking (“Customer,” “you,” or “your”). By placing a booking through the Yellow Bins website, by phone, or in person, the Customer agrees to be bound by the terms and conditions set out in this Agreement.


1. Definitions

  • “Bin” — the waste container rented by the Customer from Yellow Bins, including all bin sizes offered.
  • “Rental Period” — the period beginning on the date of bin delivery and ending on the date of bin pickup, as confirmed in the booking.
  • “Service Address” — the location at which the bin is to be delivered, placed, and picked up, as specified by the Customer at booking.
  • “Schedule A” — the list of Accepted and Prohibited Materials forming part of this Agreement.

2. Booking and Payment

2.1 Bookings may be made through the Yellow Bins website, by phone at (587) 532-9727, or by email at admin@yellowbins.co. All bookings are subject to bin availability and confirmation by Yellow Bins.

2.2 The base rental fee, included rental period, and included tonnage allowance are as quoted at the time of booking and confirmed by email.

2.3 Payment of the base rental fee is required at the time of booking. Payments are processed through Stripe, a PCI-compliant payment processor. Yellow Bins does not store full payment card numbers on its own systems.

2.4 All prices are quoted in Canadian Dollars (CAD) and are exclusive of GST unless otherwise stated.


3. Delivery, Placement, and Pickup

3.1 Yellow Bins will deliver the bin to the Service Address on the agreed delivery date. Specific delivery times are estimates and not guaranteed.

3.2 The Customer is responsible for ensuring that the Service Address is accessible to a delivery truck, that the placement area is clear of vehicles and obstructions, and that there is sufficient overhead clearance.

3.3 The Customer is solely responsible for selecting and authorizing the placement location for the bin. Yellow Bins is not liable for damage to driveways, sidewalks, lawns, sprinkler systems, underground utilities, septic systems, or other property at the Service Address resulting from the placement, presence, or removal of the bin.

3.4 If Yellow Bins, in its reasonable judgment, determines that a proposed placement location is unsafe or inaccessible, Yellow Bins may refuse placement at that location and propose an alternative or cancel the delivery. Trip fees under Section 5.2(f) may apply.

3.5 Pickup will be scheduled for the date confirmed at booking or, where applicable, on the Customer’s request before the end of the included rental period.


4. Customer Responsibilities

4.1 The Customer is solely responsible for the contents of the bin from the time of delivery to the time of pickup, regardless of whether the contents were placed by the Customer, the Customer’s contractors, family, employees, guests, or any third party.

4.2 The Customer shall ensure that only Accepted Materials, as defined in Schedule A, are placed in the bin.

4.3 The Customer shall not overload the bin beyond its safe lifting capacity, shall not load material above the top rail of the bin, and shall not load dense materials beyond the tonnage capacity of the bin.

4.4 The Customer shall take reasonable steps to secure the bin against unauthorized use by third parties and shall promptly notify Yellow Bins of any such use.

4.5 The Customer shall comply with all applicable federal, provincial, and municipal laws, regulations, and bylaws relating to waste disposal, including but not limited to obtaining any required permits for bin placement on public property such as streets, alleys, or boulevards.


5. Payment Card on File and Additional Fees

5.1 Authorization to Store and Charge Card

By completing a booking with Yellow Bins, the Customer expressly authorizes Yellow Bins to securely store the payment card used at checkout via Stripe, our PCI-compliant payment processor, for the duration of the Rental Period. The Customer further authorizes Yellow Bins to charge this card for any additional fees incurred during the Rental Period, as set out in this Section 5. This authorization remains in effect from the date of booking until the bin has been picked up and all rental-related charges have been fully settled.

5.2 Schedule of Additional Fees

The following fees may be charged to the card on file. All amounts are in Canadian Dollars (CAD) and exclusive of GST unless otherwise noted.

(a) Rental Extension Fee — $15.00 per day, charged for each calendar day the bin remains on site beyond the rental period included in the original booking.

(b) Overage / Additional Tonnage Fee — $89.00 per metric tonne (or pro-rated portion thereof) for any weight exceeding the tonnage allowance included with the rented bin size. Weight is determined by certified scale tickets at the disposal facility.

(c) Contamination / Prohibited Material Fee — Yellow Bins maintains a list of accepted and prohibited materials, set out in Schedule A of this Agreement. If prohibited material is found in the bin, the Customer will be charged a contamination fee determined at the sole discretion of Yellow Bins Inc., based on the type and quantity of material, additional tipping fees charged by the disposal facility, special handling or disposal costs, and any associated labour or transportation. The Customer will be notified of the assessed fee and provided with supporting documentation (photographs and, where applicable, disposal facility receipts) prior to the charge being applied.

(d) Bin Damage Fee — The Customer is responsible for any damage to the bin beyond reasonable wear and tear, including but not limited to bent or broken doors, dented or punctured walls, fire damage, graffiti, or structural damage caused by overloading, impact, or improper use. Repair costs will be charged at actual cost plus a 15% administration fee, supported by repair invoices or quotes.

(e) Relocation Fee — $95.00 per move, charged if Yellow Bins is required to relocate the bin on the Customer’s property after initial placement at the Customer’s request.

(f) Trip Fee / Dry Run Fee — $150.00, charged when Yellow Bins attempts delivery, pickup, or swap and is unable to complete the service due to circumstances within the Customer’s control, including but not limited to site inaccessibility, blocked access, vehicles or obstructions in the placement area, customer not on site when on-site presence was requested, or refusal of service upon arrival.

(g) Overweight Bin / No-Lift Fee — $150.00, charged if the bin is loaded beyond the safe lifting capacity of our truck (typically when filled above the top rail or with dense materials such as concrete, soil, or roofing shingles beyond bin capacity) and must be partially unloaded by the Customer before pickup can occur. Additional trip fees may also apply.

(h) Specialized Asbestos Disposal Service — Yellow Bins offers dedicated asbestos disposal bins as a specialized service, separate from standard bin rentals. Asbestos disposal requires advance notification, a separate quote, dedicated bin allocation, and compliance with Alberta Occupational Health and Safety regulations and disposal facility protocols. Pricing for asbestos disposal is quoted on a per-project basis and is not available through the standard online booking system. Customers requiring asbestos disposal must contact Yellow Bins directly to arrange this service.

5.3 Method of Charging

Yellow Bins will charge the card on file using Stripe’s secure payment system. Charges will appear on the Customer’s card statement as “YELLOW BINS” or a similar identifier. The Customer will receive an emailed receipt for every charge.

5.4 Disputes

Any dispute regarding an additional fee must be raised in writing to admin@yellowbins.co within seven (7) days of the charge notification. Yellow Bins will review the dispute in good faith and provide supporting documentation. Initiating a chargeback through the Customer’s bank without first attempting resolution with Yellow Bins is considered a breach of this Agreement.

5.5 Card Removal

The Customer may request removal of their card from file by emailing admin@yellowbins.co, provided that all rental charges have been fully settled and the bin has been picked up.


6. Cancellation and Refunds

6.1 Cancellations made more than 24 hours before the scheduled delivery time will receive a full refund of the base rental fee.

6.2 Cancellations made within 24 hours of the scheduled delivery time, or after the bin has been dispatched, may be subject to a trip fee under Section 5.2(f).

6.3 Once a bin has been delivered, the base rental fee is non-refundable.


7. Limitation of Liability

7.1 Yellow Bins’ total liability under this Agreement, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the Customer under the applicable booking.

7.2 Yellow Bins shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of business, or loss of data.

7.3 Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law.


8. Indemnification

The Customer shall indemnify and hold harmless Yellow Bins, its directors, officers, employees, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to: (a) the Customer’s breach of this Agreement; (b) the placement of prohibited or hazardous materials in the bin; (c) any injury to persons or damage to property arising from the Customer’s use of the bin; or (d) any violation by the Customer of applicable laws or regulations.


9. General Provisions

9.1 Governing Law. This Agreement is governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Alberta.

9.2 Entire Agreement. This Agreement, including Schedule A, constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior agreements, representations, and understandings.

9.3 Severability. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9.4 Amendments. Yellow Bins may update this Agreement from time to time. The version in effect at the time of booking governs that booking.

9.5 Notices. All notices to Yellow Bins shall be sent to admin@yellowbins.co. All notices to the Customer shall be sent to the email address provided at booking.



Schedule A — Accepted and Prohibited Materials

The following materials are accepted and prohibited in Yellow Bins rental bins. This list applies to all bin sizes unless otherwise noted. If you are unsure whether a specific item is permitted, contact Yellow Bins at (587) 532-9727 or admin@yellowbins.co before placing it in the bin.

Accepted Materials

  • Construction and demolition debris, including wood, drywall, insulation, flooring, tile, roofing materials, siding, fixtures, cabinetry, and similar building materials
  • Dry household materials, including furniture, clothing, textiles, toys, books, and general non-organic household items
  • Electronics, including televisions, computers, monitors, small appliances, and similar items
  • Major appliances, including refrigerators, freezers, stoves, washers, dryers, and dishwashers
  • Tires
  • Yard waste, including tree branches, clippings, mulch, grass, leaves, and brush

Prohibited Materials

The following materials are not accepted in any standard Yellow Bins rental bin:

  • Biomedical / medical waste, including sharps, syringes, pharmaceuticals, blood-contaminated items, and any waste regulated under Alberta biomedical waste guidelines
  • Hazardous waste, including paints, solvents, stains, varnishes, adhesives, cleaning chemicals, pool chemicals, pesticides, herbicides, motor oil, antifreeze, batteries (automotive and household), aerosols, propane tanks, and any material labelled toxic, corrosive, reactive, or otherwise hazardous
  • Flammable or combustible waste, including fuels, oils, gasoline, diesel, kerosene, lighter fluid, and any ignitable liquids or solids
  • Asbestos — Asbestos is not accepted in standard bin rentals. Yellow Bins offers dedicated asbestos disposal bins as a specialized service, which require advance notification, separate handling protocols, and specific disposal arrangements in accordance with Alberta Occupational Health and Safety and disposal facility regulations. Customers requiring asbestos disposal must contact Yellow Bins at (587) 532-9727 or admin@yellowbins.co before booking to arrange a dedicated asbestos bin. Asbestos found in a standard rental bin without prior arrangement will result in contamination charges under Section 5.2(c), including all costs of remediation, special disposal, regulatory compliance, and any fines or penalties levied against Yellow Bins
  • Refrigerants and pressurized containers (note: refrigerators, freezers, and air conditioning units are accepted as whole appliances, but loose refrigerant canisters and pressurized cylinders are prohibited)
  • Dirt, sod, soil, sand, gravel, concrete, brick, asphalt, stone, and similar aggregate or heavy fill materials — these materials require a dedicated clean-load bin; contact Yellow Bins for separate aggregate disposal arrangements
  • Liquids of any kind, including water-filled containers
  • Animal carcasses, organic food waste in large volumes, and septic waste
  • Any material prohibited by federal, provincial, or municipal law or regulation, or by the receiving disposal facility

Consequences of Prohibited Materials in Bin

If prohibited material is discovered in the bin at any stage — pickup, transport, weighing, or tipping — the Customer will be charged a contamination fee under Section 5.2(c) of the Rental Agreement. In severe cases, including but not limited to discovery of hazardous, biomedical, or asbestos materials, Yellow Bins reserves the right to:

  • Refuse pickup until the prohibited material is removed by the Customer at the Customer’s expense
  • Charge all costs of remediation, special disposal, and any fines or penalties levied against Yellow Bins to the Customer’s card on file
  • Suspend or terminate the rental agreement without refund

Customer Acknowledgment

By completing a booking with Yellow Bins Inc., the Customer acknowledges that they have read, understood, and agreed to be bound by this Bin Rental Agreement and Schedule A in their entirety.
